The essentials
- Who you buy from: the coach named on this website and in your order summary. CoCoach provides the platform and handles the payment.
- What you pay, and for how long: the price, billing period, any binding period and the notice period are in your order summary. Payment is taken automatically each billing period.
- 14 days to change your mind: you can withdraw within 14 days of your purchase and get back everything you have paid, also if your Services have already started. If your purchase is digital content, such as a fixed program, you lose this right once you get access, provided you agreed to that at checkout. Your order summary tells you which applies.
- Cancel at any time: in your account, or by contacting me, for example by email. Your subscription ends at the end of a billing period, in accordance with your binding period and notice period. You will receive a cancellation confirmation.
- Price changes: your price only changes if you accept a new one, or if I give you at least two months' notice by email, in which case you can leave before the new price applies.
1. Who you contract with
1.1 I am the coach named on this website and in your order summary ("I", "me"). Your contract is with me, and I am responsible to you for the coaching and related services I sell (the "Services").
1.2 I sell the Services through my website, the CoCoach app and the CoCoach platform (together the "Platform"). CoCoach provides the technology and processes payments on my behalf. CoCoach is not a party to your contract.
1.3 My name, registration number (if I have one), address and email address are shown on my website. These details, and my phone number if I have one, are also in your order summary and order confirmation. You can contact me through any of these.
1.4 These Terms and Conditions (the "Terms") apply to your purchase. How I process your personal data is described in my Privacy Policy.
2. How the contract is made
2.1 Before you pay, the order summary shows what the Services include, the price, the billing period, any binding period, the notice period, the start date, and whether your purchase is digital content (see 5.5).
2.2 The contract is concluded when you complete your order. I then send you an order confirmation by email with your order summary and information about your right of withdrawal.
2.3 You must be 18 or over to buy the Services. If you are under 18, a parent or guardian must buy them for you or approve the purchase.
3. What you get
3.1 I deliver the Services as described in your order summary, with reasonable care and skill. I am responsible for the content and for the support you need to use the Services.
3.2 The Services are used in the CoCoach app or in a web browser. You need a smartphone or computer with an up-to-date operating system and an internet connection.
3.3 Results vary from person to person. Your progress depends on your own effort, consistency and health, so I cannot guarantee a particular result.
4. Price and payment
4.1 You pay the price in your order summary. Prices include VAT, and I am responsible for the VAT.
4.2 The first payment is taken when you complete your order, or on the start date in your order summary if that is later. For a subscription, payment is then taken automatically at the start of each billing period until your subscription ends.
4.3 You can pay with the payment methods shown at checkout, such as debit and credit cards or, where available, a direct bank payment. Later payments are taken from the payment method you chose.
4.4 If a payment fails, you receive an email with a link to pay. If you have not paid within 7 days of the failed payment, your access is paused until you pay. If you have still not paid within 14 days, your subscription ends and any remaining binding period no longer applies.
4.5 I can change the price of your subscription in two ways:
- I propose a new price, which only applies if you accept it on the Platform. If you do not accept it, your current price continues.
- I give you notice of a new price by email at least two months before it applies. You can then cancel so that your subscription ends no later than the day the new price would apply. From that day, any remaining binding period no longer applies.
5. Your right of withdrawal
5.1 You can withdraw from your purchase within 14 days of the day you completed your order, without giving a reason. This right follows from the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
5.2 To withdraw, use the withdrawal button via the app or on my website, or contact me, for example by email or in the chat. It is enough that you send your message before the 14 days have passed. I confirm by email when I have received it.
5.3 If you withdraw, I refund everything you have paid, in full, within 14 days of receiving your message, using the same payment method you used, at no cost to you.
5.4 This also applies if your Services have already started. You do not pay for the Services you received before you withdrew.
5.5 If your order summary states that your purchase is digital content, such as a fixed program, resources or meal plans without ongoing coaching, your right of withdrawal ends when you get access. This only applies if you expressly agreed at checkout that access starts within the 14 days and acknowledged that you thereby lose your right of withdrawal. Your order confirmation repeats that agreement.
6. Duration and cancellation
6.1 A subscription runs until you or I end it. It is binding for any binding period in your order summary, except where these Terms or the law let you end it earlier, for example under 4.4, 4.5, 5, 10.2 or 12.3.
6.2 You can cancel at any time, in your account or by contacting me, for example by email or in the chat. Your subscription then ends at the end of the billing period in which the notice period in your order summary runs out, but not before the end of any binding period. I confirm the end date by email. Until then you keep your access and pay as usual.
6.3 A one-off purchase, such as a fixed program, does not renew. It gives you access for the period stated in your order summary.
6.4 If I stop offering the Services, for example because I close my business or a cohort does not go ahead, your purchase ends, you are not charged again, and I refund what you have paid for the time after it ends.
7. When I can block or end your access
7.1 I may end the contract with immediate effect, or block your access while I look into it, if I have reasonable grounds to believe that you:
- let someone else use your account,
- copy, share or extract content from the Services, for example for another coach or business,
- threaten, harass or abuse me or other members, or otherwise seriously breach section 8, or
- act fraudulently, for example in connection with a payment.
7.2 If the breach is minor and can be fixed, I will first ask you to fix it. Otherwise I will tell you promptly in writing why I have ended the contract or blocked your access.
7.3 While your access is blocked, you pay nothing. If I end the contract, you pay nothing after that date and any remaining binding period no longer applies. I keep what you have paid for the month in which I end the contract; if you have paid for any later months, I refund those.
8. How you may use the Services
8.1 Your account is personal. Do not share your login details or let anyone else use your account. Keep your login details safe, and tell me if you think someone else has used your account.
8.2 The Services are for your own private use. You may not copy, share, resell or publish them, or use them in a business.
8.3 You may not misuse the Services or the Platform. That means no unlawful use, no malicious code, no attempts to break into, overload or reverse engineer the Platform, and no collecting data from it.
8.4 In chat, groups and other community areas, treat me and other members with respect, and do not post anything threatening, discriminatory, sexually explicit or otherwise offensive. If you do, I may delete your message and ask you not to repeat it. If the behaviour is serious or continues, I may end the contract under section 7.
8.5 Please keep your contact and payment details up to date.
9. My content
9.1 The programs, plans, videos, texts and other content in the Services belong to me or my licensors. You get a personal right to use them for as long as you have access to the Services. You cannot transfer that right to anyone else.
9.2 Nothing in these Terms gives you the right to use my name, logo or trademarks.
9.3 If anyone claims that the Services infringe their rights, I deal with the claim.
10. Changes to the Services
10.1 These Terms do not change to your disadvantage. The version that applied when you made your purchase applies for as long as your purchase lasts. The only exceptions are changes that are solely to your advantage and changes the law requires; I will tell you about those by email.
10.2 I may update the content of the Services, for example to adapt your program to your progress, improve or replace exercises and recipes, fix errors or comply with new legislation. These updates cost you nothing. If an update makes your access to or use of the Services more than marginally worse, I will tell you in advance, and you can then end the contract free of charge within 30 days of my message or the update. I refund what you have paid for the time after the contract ends.
10.3 I recommend that you install app updates when they become available. If you do not install an update I have told you about, some features may stop working.
11. Health and safety
11.1 The Services give general guidance on exercise and nutrition. They are not medical advice, diagnosis or treatment, and they do not replace healthcare.
11.2 If you have, or suspect you have, an illness, injury or other health condition, for example heart or circulation problems, high blood pressure, joint problems, recent surgery, pregnancy, pelvic floor problems or an eating disorder, I recommend that you talk to a doctor before you start. Please also tell me about anything that matters for your plan.
11.3 Exercise involves a risk of injury. Train within your own ability, choose suitable weights and intensity, and make sure your training space and equipment are safe. Stop immediately if you feel pain, dizziness or unwell, and seek medical help if needed.
11.4 This section does not limit my liability under section 12.
12. Liability
12.1 If I do not deliver the Services as agreed, I am responsible for loss or damage you suffer as a foreseeable result. Loss or damage is foreseeable if it was an obvious consequence, or if we both knew it might happen when the contract was made.
12.2 The Services are for private use. I am not liable for business losses, such as loss of profit or business opportunities, if you use the Services for business purposes.
12.3 The Services depend on the Platform, the internet and payment providers, and may occasionally be unavailable, for example during maintenance, technical faults, outages at providers, or when access is suspended to protect the Platform against attacks or misuse. Neither I nor CoCoach is liable for such interruptions, and they do not entitle you to compensation. If you cannot use the Services for more than 14 days in a row, you can end the contract with immediate effect, and you get back what you have paid for the period you could not use them.
12.4 Nothing in these Terms limits my liability for intent or gross negligence, for death or personal injury, or where mandatory law gives you more.
13. Personal data and marketing
13.1 I process your personal data as described in my Privacy Policy.
13.2 I only send you marketing if you have separately consented to it. You can withdraw your consent at any time in your account settings or by contacting me.
13.3 I always send you messages about your purchase and the Services, such as payment reminders and changes to the Services, even if you do not receive marketing.
13.4 When your purchase ends, your data is kept and used as described in my Privacy Policy, for example so you can pick up where you left off if you come back. You can ask me for a copy of the content you added, such as check-ins, logs and progress photos, free of charge and in a commonly used format, or ask me to delete it.
14. Complaints, applicable law and disputes
14.1 If the Services do not match what we agreed, contact me, for example by email or in the chat. Please do so within a reasonable time after you notice the problem. I will respond as soon as possible.
14.2 You have the rights the law gives you when a service is faulty. I correct the fault, and if that does not happen within a reasonable time, you may be entitled to a price reduction or, if the fault is serious, to end the contract, as well as to compensation.
14.3 These Terms are governed by the law of England and Wales. This does not take away the protection you have under the mandatory consumer law of the country where you live.
14.4 If we cannot resolve a disagreement between us, you can bring proceedings in the courts of England and Wales. If you live in Scotland, you can also bring proceedings in the Scottish courts, and if you live in Northern Ireland, in the Northern Irish courts. I can only bring proceedings against you in the courts of the part of the United Kingdom where you live.
